These Terms of Service govern access to and use of Clear the Calendar™, a fundraising technology platform operated by Trend Jockey®. By creating an account, launching or administering a fundraiser, participating in a fundraiser, or making a payment through the platform, you agree to these Terms.
1. Platform role
Clear the Calendar provides technology that allows organizations, teams, schools, clubs, programs, participants, parents or guardians, and supporters to create, manage, share, and support fundraising campaigns. Clear the Calendar is not the beneficiary of a fundraiser and does not control how fundraising proceeds are ultimately used by the fundraising organization.
2. Fundraiser organizer responsibilities
Fundraiser organizers are responsible for ensuring that their campaigns are authorized, accurate, lawful, and consistent with all applicable school, organizational, athletic, nonprofit, tax, payment, and other requirements. Organizers must have authority to collect funds for the stated purpose and are responsible for the use and accounting of proceeds after payout.
3. Participant and parent or guardian access
A participant profile may be accessed by the participant and by one or more authorized parents or guardians. Users who invite or approve access represent that they are authorized to do so. Where a participant is a minor, the applicable organizer and parent or guardian are responsible for ensuring that participation, profile information, photos, and other submitted content are authorized.
4. Payments, platform charges, and processing fees
Supporters authorize the total amount displayed at checkout. The sponsored amount designated for the fundraiser, Clear the Calendar platform charges, and payment-processing costs may be displayed as separate amounts. Payment processing is provided by third-party payment processors, including Stripe, and is also subject to their applicable terms and policies.
5. Payouts and holds
Payout timing may depend on the selected payout method, payment settlement, identity or account verification, processing requirements, dispute risk, fraud review, and other operational or compliance considerations. Clear the Calendar may delay, withhold, offset, or suspend payouts when reasonably necessary to address refunds, chargebacks, suspected fraud, legal obligations, negative balances, payment-processing risk, or violations of these Terms.
6. Refunds, disputes, and chargebacks
Payments are generally final once successfully processed. Refunds may be considered for duplicate transactions, processing errors, unauthorized transactions, or other circumstances Clear the Calendar determines are appropriate. Chargebacks and payment disputes may result in funds being withheld, reversed, offset against future payouts, or recovered from the fundraising organization to the extent permitted by applicable law and payment-processor rules.
7. Prohibited use
Users may not use Clear the Calendar for fraudulent, deceptive, misleading, illegal, unauthorized, discriminatory, abusive, dangerous, or infringing activity. Users may not impersonate another person or organization, misrepresent the purpose of a fundraiser, interfere with platform security, manipulate transactions, or use the platform in a manner that creates unreasonable payment or compliance risk.
8. Suspension and termination
Clear the Calendar may restrict, suspend, or terminate access to an account or fundraiser when necessary to investigate suspected fraud, unauthorized activity, payment disputes, legal or regulatory concerns, violations of these Terms, or risks to users, the platform, or payment partners.
9. No fundraising guarantee
Clear the Calendar does not guarantee any level of donations, participation, calendar completion, fundraising proceeds, or financial results.
10. User content
Users retain responsibility for information, images, names, messages, branding, and other content they submit. Users grant Clear the Calendar the limited right to host, display, process, and transmit that content as necessary to operate and promote the applicable fundraiser and provide the service.
11. Third-party services
The platform may depend on third-party providers for payment processing, hosting, email, analytics, communications, and related services. Clear the Calendar is not responsible for outages, restrictions, or failures caused by third-party services outside its reasonable control.
12. Disclaimer of warranties
The platform is provided on an “as is” and “as available” basis to the fullest extent permitted by law. Clear the Calendar disclaims warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
13. Limitation of liability
To the fullest extent permitted by law, Clear the Calendar and Trend Jockey will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, loss of goodwill, or loss arising from the acts or omissions of a fundraiser organizer, participant, supporter, or third-party service provider.
14. Indemnification
Fundraiser organizers and users agree to indemnify and hold harmless Clear the Calendar, Trend Jockey, and their affiliates, officers, employees, and agents from claims, losses, liabilities, and reasonable expenses arising from their misuse of the platform, violation of these Terms, unauthorized fundraising activity, submitted content, or violation of applicable law or third-party rights.
15. Changes to the service or Terms
Clear the Calendar may modify the platform or these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use after an update constitutes acceptance of the updated Terms to the extent permitted by law.
16. Governing law
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles, except where applicable law requires otherwise.
