These Terms of Service govern access to and use of Clear the Calendar™, a fundraising technology platform operated by Trend Jockey®. By creating an account, launching or administering a fundraiser, participating in a fundraiser, or making a payment through the platform, you agree to these Terms.
1. Platform role
Clear the Calendar provides technology that allows organizations, teams, schools, clubs, programs, participants, parents or guardians, and supporters to create, manage, share, and support fundraising campaigns. Clear the Calendar is not the beneficiary of a fundraiser and does not control how fundraising proceeds are ultimately used by the fundraising organization.
2. Fundraiser organizer responsibilities
Fundraiser organizers are responsible for ensuring that their campaigns are authorized, accurate, lawful, and consistent with all applicable school, organizational, athletic, nonprofit, tax, payment, and other requirements. Organizers must have authority to collect funds for the stated purpose and are responsible for the use and accounting of proceeds after payout.
Organizers are also responsible for maintaining accurate contact information, verifying their email address, adding or inviting participants, selecting appropriate fundraiser dates, and completing all requested payout and identity-verification steps. A fundraiser may be scheduled before payout setup is complete. At least one active participant and any other launch requirements shown in the organizer dashboard must be satisfied before a fundraiser can begin accepting support.
3. Participant and parent or guardian access
A participant profile may be accessed by the participant and by one or more authorized parents or guardians. Users who invite or approve access represent that they are authorized to do so. Where a participant is a minor, the applicable organizer and parent or guardian are responsible for ensuring that participation, profile information, photos, and other submitted content are authorized.
3A. Geographic availability and Canadian organizers
We welcome inquiries from Canadian schools, teams, and organizations. Until Stripe self-service onboarding for Canadian payout accounts is activated on Clear the Calendar, we will work with Canadian organizers individually to confirm an appropriate payment and payout arrangement. Contact us before inviting participants or collecting payments so we can review the fundraiser, its authorized recipient, payout method, currency, timing, and any required verification. We will confirm the arrangement before payments begin; creating an account or draft alone does not establish an approved payout method.
Organizers are responsible for obtaining any required school or organizational approval, choosing an authorized payout recipient, accounting for proceeds, and complying with applicable Canadian and local law. If an individual receives funds on behalf of an organization, that individual represents that they are authorized to do so and is responsible for handling the funds under the organization’s rules. Availability of payment or payout services remains subject to processor eligibility, verification, and applicable legal requirements.
4. Payments, platform charges, and processing fees
Unless checkout explicitly states otherwise, all dollar amounts on the platform, including calendar sponsorships, business sponsorships, and platform fees, are in U.S. dollars (USD). Canadian supporters may be charged in USD. Their card issuer or payment provider may convert that charge to Canadian dollars and apply its own exchange rate or foreign transaction fees; those charges are separate from the amounts shown by Clear the Calendar and are outside our control. A Canadian organizer’s payout currency and any conversion will be addressed in the confirmed arrangement; no particular CAD amount or exchange rate is guaranteed.
Supporters authorize the total amount displayed at checkout. The amount selected on the fundraising calendar is the sponsored amount credited to the fundraiser. Clear the Calendar charges the supporter a separate Platform & Processing Fee, so the fee does not reduce the sponsored amount credited to the fundraiser.
The current Platform & Processing Fee schedule is:
- Sponsored amount of $0.01 through $5.00: $0.79
- Sponsored amount of $5.01 through $10.00: $1.29
- Sponsored amount of $10.01 through $20.00: $1.99
- Sponsored amount of $20.01 through $31.00: $2.49
- Sponsored amount above $31.00: 8% of the sponsored amount plus $0.60, rounded to the nearest cent
The applicable fee and total charge are displayed before payment is submitted. Payment processing is provided by third-party payment processors, including Stripe, and is also subject to their applicable terms and policies. Clear the Calendar may revise this fee schedule from time to time by updating these Terms; the fee displayed at checkout at the time of a transaction controls that transaction.
4A. Community business sponsorships
An organizer may optionally enable paid promotional placements for community businesses. These transactions are business sponsorships, not calendar donations, and are not represented by Clear the Calendar as tax-deductible charitable contributions. A purchaser represents that they are authorized to act for the named business and to provide its name, logo, website, tagline, and other submitted content.
The Community Supporter tier is $100, of which $80 is credited to the fundraiser and $20 is retained by Clear the Calendar before payment processing costs. The Featured Community Sponsor tier is $250, of which $200 is credited to the fundraiser and $50 is retained by Clear the Calendar before payment processing costs. Clear the Calendar may waive its share for a specific fundraiser; when it does, the amount shown in the sponsorship experience controls.
A paid sponsorship remains private until approved by the fundraiser organizer or Clear the Calendar. Organizers may approve a placement, request changes, or reject it. Rejected placements are refunded to the original payment method. If an organizer does not respond, Clear the Calendar may review the placement for compliance; the passage of 72 hours does not cause an automatic refund. Clear the Calendar may hide, reject, remove, or refund a placement that is misleading, unlawful, inappropriate, unsafe, infringing, or inconsistent with these Terms.
Approved placements appear in the locations described for the selected tier while the corresponding fundraiser pages are available. The Community Supporter tier appears on the main fundraiser page; the Featured Community Sponsor tier also appears on participant pages. Submitted logos, names, websites, and taglines may be reviewed, and changes may be requested before publication. A sponsorship purchases a promotional placement, not a guarantee of views, clicks, customers, donations, or a specified audience size. Purchasers must have the rights to the branding and links they submit.
Approved fundraiser shares are added to the fundraiser payout ledger and are subject to the same payout timing, holds, disputes, fraud review, and processor availability described below. Sponsorship totals do not count as calendar donations and do not alter participant calendars, leaderboards, activation rates, or donation conversion metrics.
5. Fundraiser activation, payouts, and holds
Completion of payout setup is not required to schedule a fundraiser or for an otherwise eligible fundraiser to begin accepting payments. Payments collected before payout setup is complete are processed through Clear the Calendar’s payment-processing environment and are not released to the fundraising organization until the organizer has completed all required payout instructions, identity verification, acceptance of applicable payout terms, and any additional compliance review.
For an otherwise eligible fundraiser with completed payout setup, proceeds ordinarily become eligible for payout no earlier than five days after the fundraiser closes. This is an eligibility period, not a guaranteed deposit date. Actual payout timing may depend on the selected payout method, payment settlement, identity or account verification, processor availability, banking timelines, dispute risk, fraud review, and other operational or compliance considerations.
Clear the Calendar may send email, in-platform, or push-notification reminders to complete payout setup. If payout setup remains incomplete 30 days after a fundraiser closes, the matter may be escalated for manual review and additional outreach. The 30-day review does not create an automatic refund, automatic forfeiture, or guaranteed payout. Depending on the circumstances, Clear the Calendar may continue holding the proceeds, request additional information, restrict account features, issue refunds where appropriate, or take other action required by law, payment-processor rules, or these Terms.
Clear the Calendar may delay, withhold, offset, reverse, or suspend payouts when reasonably necessary to address refunds, chargebacks, suspected fraud, legal obligations, negative balances, payment-processing risk, incomplete or inaccurate payout information, or violations of these Terms.
6. Refunds, disputes, and chargebacks
Payments are generally final once successfully processed. Refunds may be considered for duplicate transactions, processing errors, unauthorized transactions, or other circumstances Clear the Calendar determines are appropriate. Chargebacks and payment disputes may result in funds being withheld, reversed, offset against future payouts, or recovered from the fundraising organization to the extent permitted by applicable law and payment-processor rules.
7. Prohibited use
Users may not use Clear the Calendar for fraudulent, deceptive, misleading, illegal, unauthorized, discriminatory, abusive, dangerous, or infringing activity. Users may not impersonate another person or organization, misrepresent the purpose of a fundraiser, interfere with platform security, manipulate transactions, or use the platform in a manner that creates unreasonable payment or compliance risk.
8. Suspension and termination
Clear the Calendar may restrict, suspend, or terminate access to an account or fundraiser when necessary to investigate suspected fraud, unauthorized activity, payment disputes, legal or regulatory concerns, violations of these Terms, or risks to users, the platform, or payment partners.
9. No fundraising guarantee
Clear the Calendar does not guarantee any level of donations, participation, calendar completion, fundraising proceeds, or financial results.
10. User content
Users retain responsibility for information, images, names, messages, branding, and other content they submit. Users grant Clear the Calendar the limited right to host, display, process, and transmit that content as necessary to operate and promote the applicable fundraiser and provide the service.
11. Third-party services
The platform may depend on third-party providers for payment processing, hosting, email, analytics, communications, and related services. Clear the Calendar is not responsible for outages, restrictions, or failures caused by third-party services outside its reasonable control.
12. Disclaimer of warranties
The platform is provided on an “as is” and “as available” basis to the fullest extent permitted by law. Clear the Calendar disclaims warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
13. Limitation of liability
To the fullest extent permitted by law, Clear the Calendar and Trend Jockey will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, loss of goodwill, or loss arising from the acts or omissions of a fundraiser organizer, participant, supporter, or third-party service provider.
14. Indemnification
Fundraiser organizers and users agree to indemnify and hold harmless Clear the Calendar, Trend Jockey, and their affiliates, officers, employees, and agents from claims, losses, liabilities, and reasonable expenses arising from their misuse of the platform, violation of these Terms, unauthorized fundraising activity, submitted content, or violation of applicable law or third-party rights.
15. Changes to the service or Terms
Clear the Calendar may modify the platform or these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use after an update constitutes acceptance of the updated Terms to the extent permitted by law.
16. Governing law
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles, except where applicable law requires otherwise.
